Not agreeing with July 17th 2024 Social Security Administration, Administrative Law Judge, Ann C. Paschall hearing decision denied request over-payment at-fault determination reversed (see: HA-501 - REQUEST ALJ HEARING). On July 31st 2024 requested the Appeals Council (AC) review the ALJ's action. Filed an HA-520, Request for Review of Hearing Decision/Order. Request was sent Certified, Tracking Number: 9505510582284215004589. Request for Review received August 5th 2024 in Baltimore, MD 21235.

On Monday July 29th 2024, Petitioner

Received, dated July 17th 2024, DECISION letter from Social Security Administration Administrative Law Judge Ann C. Paschall (475 N Main St., Mauldin, South Carolina 29662-9954). The letter is a summary of Social Security Administration (SSA) correspondence with Petitioner, November 26th 2023 thru March 25th 2024 with a decision to further assert an over payment of Supplemental Security Income (SSI). The decision determination asserted in agreement with Social Security Administration partial decision determination dated March 6th 2024. The ISSUE:

  • that an over payment recovery would worsen and promote ‘Financial and Emotional suffering’ in petitioners’ life was not considered in the decision. 
  • amended December 11, 2023 over-payment determination in err incorporating 20 CFR § 416.1121. Types of unearned income. (c) and in err connected a Blog that generates no Google payments and it’s not related to YouTube channel and or YouTube Partner Program; effectively continuing usage of Income-Counting rule in determining Supplemental Security Income (SSI).

On Friday December 15th 2023 Petitioner,

from the onset of the over payment determination and recovery attempt announced to Ms Julie Smith, Administrator Social Security Administration field office Anderson South Carolina (4 Civic Center Boulevard extension, Anderson South Carolina 29625) that an over payment recovery of Supplemental Security Income (SSI) would further aggravate money shortages that to date have been litigated by steep credit card debt. Credit Cards used because no Banking institution, despite Petitioner’s good credit, has been willing to lend money at any reasonable rate of interest to consolidate debt.

Social Security Administration reduced Social Security Administration Supplemental Security Income over payment determination dated Saturday February 3rd 2024 after the office of  Honorable Joseph R Biden President of the United States of America (1600 Pennsylvania Avenue Northwest Washington, D.C. 20500) requested Social Security Administration evaluate over payment determination. After Reevaluation over payment reduced $5,727.84 WITH Social Security Administration DEMANDING RECOVERY OF $7,696.02. ADDING ‘Financial and Emotional suffering’ in petitioners’ life and in err connecting a Blog that generates no Google payments and it’s not related to YouTube channel and or YouTube Partner Program; effectively continuing usage of Income-Counting rule in determining Supplemental Security Income (SSI).

July 17th 2024 DECISION,

Only confirms Social Security Administration revised over payment determination dated March 6th 2024. It does not address the FACT that over payment recovery is AN INCREASE in financial and emotional hardship in petitioner’s life. An act against equity and good faith, an act against everything that is morally and ethically acceptable and is in err connecting a Blog that generates no Google payments and it’s not related to YouTube channel and or YouTube Partner Program; thereby effectively continuing usage of Income-Counting rule in determining Supplemental Security Income (SSI).

In light of the foregoing petitioner request Appeals Council revise over payment determination incorporating over payment recovery dismissal.
